Decisions on the subordination of creditors’ claims in the amount of more than 50 million rubles withstood in the appeal
The plaintiffs filed claims in the amount of 50.84 million rubles for satisfaction in the 3rd stage of the register of creditors’ claims in the first instance. YUKO lawyers managed to prove the actual affiliation and inclusion in the same group of the Creditor and the Debtor, as well as the fact of compensatory financing. Thus, claims in the amount of 50.84 million rubles were subordinated: they were recognized as subject to satisfaction after the repayment of creditors’ claims in the order preceding the distribution of the liquidation quota. Judicial acts were left unchanged by the rulings of the arbitration courts of appellate instances, and the creditors’ appeals were not satisfied.
