The case of YUKO lawyers on bringing the Ural Fuel Union Debtors’ controlling persons (DCP) to subsidiary liability was included in the top-8 bankruptcy disputes as part of the study “The case by Legal Insight 2023”.
In this dispute, we were able to prove and bring to subsidiary liability both shadow and nominal DCPs jointly and severally, without mitigating liability for nominal managers. This created a real opportunity for debt collection by creditors, taking into account the fact that there are no funds in the debtor’s bankruptcy estate, in particular due to dishonest actions of the controlling persons held liable.
