The appeal revoided the defining of the first instance and recognized the transactions worth of more than 172,9 mln.rub. invalid
The Court of appeal instance overturned the ruling of the court of First instance, recognizing the presence of signs of affiliation between the Debtor and the bank to which the Debtor transferred more than 172 million rubles. The court also noted that in the case under consideration, the disputed transactions gave greater preference in satisfying the claim over other creditors. The consequences of the invalidity of the transactions in the form of recovery of funds are applied.
