Court of appeal invalidated transaction on the sale of shares worth of more than 50 MLN.RUB.
Court of appeal reversed the decision of the 1st instance court and returned to the bankruptcy estate the funds in the amount of
51 250 000,00 RUB., received from the sale of shares to a person affiliated with the debtor.
The court took into account the lack of reliable evidence testifying the reality of the transaction and receipt of funds, as well as evidence of their spending by the debtor.
In addition, it was established that two persons were included in one group, the conclusion of a transaction in order to withdraw the only liquid and registered asset of the debtor.
