Cassation: to apply the consequences of declaring transactions invalid in the form of solidary recovery from respondents more than 661 MLN. RUB.
Thanks to the efforts of YUKO lawyers the court of cassation upheld the ruling of the court of appeal, and left the applicants’ cassation complaint without satisfaction.
In the first instance the Principals’ application was denied in the recognition of transactions worth of more than 661 million rubles as invalid. The judges of the appellate instance overturned this ruling, applying the consequences of the invalidity of transactions in the form of jointly and severally recovering losses caused to the debtor and his creditors within the limits of the unreasonably received benefit from invalid transactions.
